Fluencerr LLC ("Fluencerr," "we," "us," or "our") operates the Fluencerr mobile application and website (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our Service.

By using Fluencerr, you agree to the collection and use of information in accordance with this policy.

1. Information We Collect

We collect the following types of information:

  • Account information: Name, username, email address, and phone number when you register.

  • Waitlist and signup data: If you submit your information through our website waitlist or interest forms, we collect your name, email address, Instagram handle, and any other details you voluntarily provide. This information is used solely to notify you about Fluencerr availability and updates.

  • Creator applications: When you apply as a Fluencerr creator through our website, we collect your name, phone number, email address, Instagram handle, and follower information. This is used to evaluate your eligibility, contact you about your application, and send you updates about partner venues, brand opportunities, and Fluencerr news.

  • Brand and venue partner applications: When a business applies to become a Fluencerr partner venue through our website, we collect business name, contact name, email address, phone number, location, and other business details provided in the application form. This is used solely to evaluate and process partnership applications.

  • Instagram account data: When you connect your Instagram account, we access your Instagram username, follower count, account type, and media data through the Meta (Instagram) API. We only request data necessary to verify your creator status and display your profile within the app.

  • Location data: General location (city/region) to show relevant venues near you and to deliver relevant venue promotions and sponsored campaigns targeted to creators in your area. We do not track your precise real-time location continuously or when the app is closed.

  • Usage data: QR scan activity, perk redemption history, posts submitted for verification, and in-app activity logs.

  • Device information: Device type, operating system, and app version for support and analytics purposes.

  • Push notification tokens: When you enable push notifications, we collect a device token to send you perk confirmations, check-in reminders, Reel reward alerts, venue campaigns, and other app notifications. You can disable push notifications at any time in your device settings.

  • Referral data: When you join Fluencerr through a referral code or invite another creator, we record the referral relationship to track and credit referrals within the app.

  • Leaderboard data: Your username or anonymized identifier (e.g., Creator #47) and activity stats may be displayed publicly to other Fluencerr users on in-app leaderboards based on your privacy preference set during onboarding.

  • Website cookies and analytics: Our website uses cookies and third-party analytics tools to understand how visitors interact with our site. You can control cookie preferences through your browser settings.

  • Payment information: Subscription billing is processed securely through Apple's App Store (StoreKit). We do not store your payment card details.

  • Sign-in with Apple: If you choose to sign in using Apple ID, we receive a unique identifier and, optionally, your name and email address from Apple. We do not receive your Apple ID password. Your use of Sign in with Apple is governed by Apple's Privacy Policy.

  • Sign-in with Google: If you choose to sign in using Google, we receive your Google account name, email address, and profile photo. We do not receive your Google password. Your use of Google Sign-In is governed by Google's Privacy Policy.

2. How We Use Your Information

We use the information we collect to:

  • Create and manage your Fluencerr account

  • Process waitlist and interest form submissions and notify you when access becomes available

  • Review and respond to creator applications and determine eligibility for the Fluencerr platform

  • Review and respond to brand and venue partner applications and facilitate onboarding

  • Verify your creator status and eligibility for perks

  • Display your profile to partner venues

  • Process QR check-ins and perk redemptions

  • Verify Instagram Story posts through the Instagram Mentions API

  • Manage your subscription and billing

  • Send you push notifications about perks, check-in confirmations, Reel reward alerts, and app updates

  • Send you SMS notifications about your account and, where consented, promotional updates from Fluencerr and partner venues

  • Track and credit referrals within the app

  • Display leaderboard rankings based on your privacy preference

  • Improve our Service and develop new features

  • Comply with legal obligations

3. Instagram and Meta Data

Fluencerr integrates with the Instagram Graph API to verify creator accounts. When you connect your Instagram account:

  • We access your Instagram profile information, follower count, and media data

  • We use Instagram's Mentions webhook to verify when you tag @fluencerr_ in your Instagram Stories

  • We do not post to your Instagram account on your behalf without your explicit action

  • You can disconnect your Instagram account at any time in your profile settings

Your use of Instagram is also governed by Instagram's Privacy Policy and Terms of Use.

4. How We Share Your Information

We do not sell your personal information. We may share your information with:

  • Partner venues: Your creator profile (username, follower count, tier) is shared with venues when you check in or redeem a perk.

  • Venue promotions and sponsored campaigns: Partner venues may pay Fluencerr to distribute promotional content, offers, or campaigns to opted-in creators through the app or via email and SMS. Fluencerr is the sole sender of these communications — your contact information is never shared directly with venues. You can opt out of promotional messages at any time by contacting us at info@fluencerr.com or following the unsubscribe instructions in any message.

  • Service providers: We use Supabase for database and authentication services, Apple for subscription billing, and Twilio for SMS notifications. These providers process data on our behalf under confidentiality agreements. If you receive SMS messages from Fluencerr, you can reply STOP at any time to opt out. Message and data rates may apply.

  • Meta (Instagram): Data shared via the Instagram Graph API is subject to Meta's data policies.

  • Legal requirements: We may disclose your information if required by law or to protect the rights, property, or safety of Fluencerr, our users, or others.

5. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with the Service. You may request deletion of your account and associated data at any time by contacting us at info@fluencerr.com.

6. Your Rights

Depending on your location, you may have the following rights regarding your personal data:

  • Access the personal information we hold about you

  • Request correction of inaccurate data

  • Request deletion of your data

  • Withdraw consent for data processing where applicable

  • Lodge a complaint with your local data protection authority

7. Children's Privacy

Fluencerr is not directed at individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected information from a minor, please contact us immediately so we can remove it.

8. Security

We implement industry-standard security measures to protect your information, including encrypted data transmission (TLS/HTTPS), secure database storage via Supabase, and access controls limiting who within our organization can access personal data. However, no method of transmission over the internet is 100% secure.

9. Third-Party Links

Our Service may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties and encourage you to review their privacy policies.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by updating the "Last updated" date at the top of this page and, where appropriate, through in-app notifications. Your continued use of the Service after any changes constitutes your acceptance of the updated policy.
